Why we focus on arbitration

Most business contracts in India now carry an arbitration clause, and most people only read it once a dispute has started. A contractor with an unpaid final bill, a supplier whose buyer stopped paying, a company locked in a dispute with its joint venture partner, a borrower who has just received a lender's notice naming an arbitrator they have never heard of: each of them is suddenly in a process with its own rules and its own, very short, deadlines.

Read every paper, tell the client plainly what the law allows, and put every deadline in writing on the first day.

How we start every matter

Arbitration looks simple on paper. It often isn't. The seat decides which court has jurisdiction, a missed objection to the arbitrator can be lost for good, the time to challenge an award cannot be stretched beyond 30 extra days, and an award is worth very little until the money actually reaches your account. That is why we stay with a matter after the award, through the challenge, the appeal and enforcement if it comes to that.

We don't promise results. We promise to read your file properly, file on time, and keep you informed after every hearing.

Who we help, and how

A claimant starting an arbitration, a respondent facing one, and a party holding an award each need a different plan. Here is how we usually help.

Starting and defending arbitrations

Section 21 notices and replies, appointment of arbitrators under Section 11, statements of claim and defence, counter-claims, evidence and hearings.

Urgent orders

Section 9 petitions in court and Section 17 applications before the tribunal to protect assets, stop a bank guarantee being encashed, or keep a contract alive.

Challenges and appeals

Section 34 petitions against awards, defending awards, Section 37 appeals and special leave petitions in the Supreme Court.

Enforcement

Execution of domestic awards against bank accounts, receivables and property, and enforcement of foreign awards in India.

MSME and commercial claims

MSME Facilitation Council claims and defences, commercial suits, summary suits and pre-institution mediation.

Contracts and companies

Arbitration clause drafting, settlement agreements, shareholder and joint venture disputes, and NCLT and insolvency matters.

How we take a matter forward

Every file is different, but most of them move through the same four stages.

  1. Step 1

    Listening and reading

We hear your side, then read the contract and its arbitration clause, the correspondence, the invoices and any notice, order or award. Deadlines are worked out on day one.

  2. Step 2

    Checking the other side

We look at the other party's company filings, charges, assets and past litigation. These shape both the strategy and the chances of recovering the money at the end.

  3. Step 3

    Choosing the route

An arbitration, an urgent court petition, a challenge, an MSME council claim, a commercial suit or a settlement. You get our honest view of each option, what it costs and how long it is likely to take.

  4. Step 4

    Filing and appearing

We draft, file and appear before the arbitral tribunal or the court, and update you after every hearing so you are never left guessing.
