Prayagraj is the principal seat of the Allahabad High Court, one of India's largest High Courts, with a Bench at Lucknow. For businesses in Ghaziabad, Noida, Greater Noida and across Uttar Pradesh, it is where arbitrators are appointed under Section 11, where commercial appeals from the district commercial courts are heard, and where writ petitions against UP authorities and MSME councils are filed. Prayagraj is also home to the NCLT Allahabad bench, which hears company and insolvency matters for companies registered in Uttar Pradesh and Uttarakhand.
This page is for UP businesses, especially in the NCR districts, whose matters go to Prayagraj, and for Prayagraj businesses with commercial disputes. We handle these matters from our Vaishali and Delhi offices, with associate counsel in Prayagraj. In short: the Allahabad High Court has no ordinary original civil jurisdiction for commercial matters, so Section 9 and Section 34 petitions in domestic arbitrations go to the district commercial courts; the High Court hears Section 11, international Section 9 and 34, commercial appeals and writs; and the NCLT Allahabad bench hears insolvency matters for UP companies, including those in Noida and Ghaziabad.
Whether a High Court matter goes to Prayagraj or Lucknow depends on the district. We check that before filing.

Prayagraj or Lucknow?
The Allahabad High Court sits at Prayagraj and at Lucknow. The Lucknow Bench hears matters arising from a group of districts, mainly in central and eastern Uttar Pradesh, under the High Court's rules, while the principal seat at Prayagraj hears matters from the remaining districts, including the western UP districts of Ghaziabad and Gautam Buddh Nagar. Section 11 applications, commercial appeals and writs from Ghaziabad and Noida therefore generally go to Prayagraj.
Check the district of the seat, the court below, or the cause of action before filing. Filing at the wrong seat leads to return of the papers and lost time, which matters where deadlines are short. See Allahabad High Court arbitration.

Writs against MSME councils
Buyers sometimes file writ petitions in the Allahabad High Court against orders or awards of UP MSME Facilitation Councils, arguing lack of jurisdiction or procedural unfairness. The High Court generally holds that the remedy against a council award is a Section 34 petition, with the 75% deposit under Section 19 of the MSMED Act, and that writs are maintainable only in exceptional cases, such as a total lack of jurisdiction or a breach of natural justice. Courts discourage writs that are attempts to avoid the deposit requirement.
So, for a buyer unhappy with a council award, the usual route is Section 34 in the commercial court, with the deposit. For a supplier facing a writ against a favourable award, the answer is to point to the statutory remedy. See challenge MSME award.
NCLT Allahabad
The NCLT Allahabad bench at Prayagraj hears insolvency applications, oppression petitions and other company matters for companies registered in Uttar Pradesh and Uttarakhand, including the many companies in Noida, Greater Noida and Ghaziabad. Creditors in Delhi seeking to file against a Noida company file in Prayagraj, not Delhi. Hearings are often by video, which reduces travel for NCR clients. See NCLT and NCLAT.

A Ghaziabad-seated award and a commercial appeal
Here's a made-up example. A Ghaziabad steel trader won an award of ₹1.15 crore against a Meerut construction company in an arbitration seated in Ghaziabad. The Ghaziabad commercial court dismissed the company's Section 34 petition, and the company appealed to the Allahabad High Court under Section 37, seeking a stay.
We acted for the trader, with associate counsel in Prayagraj, and attended the main hearing by video. We opposed the stay, pointing out that the appeal only re-argued the facts, and asked that the amount already deposited in the Ghaziabad court remain there. The High Court refused an unconditional stay, allowed the trader to withdraw half the deposit against security, and later dismissed the appeal.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with associate counsel in Prayagraj. This is what you can expect:
- UP focus: regular High Court work for NCR's UP districts.
- Forum accuracy: Prayagraj or Lucknow, High Court or district court.
- Efficient hearings: video where possible, in person when it matters.
- Cost clarity: associate counsel fees agreed in advance.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in Prayagraj matters
- Filing at Lucknow for a Ghaziabad matter, or the reverse
- Filing a domestic Section 34 petition in the High Court
- Using a writ to avoid the MSME 75% deposit
- Filing insolvency matters in Delhi for a Noida company
- Missing the 60-day limit for commercial appeals
- Not keeping certified copies for appeals
UP development authority disputes
Many NCR businesses have disputes with UP development authorities: the Noida Authority, the Greater Noida Authority, YEIDA and the Ghaziabad Development Authority. These include cancellation of allotments, demands for additional compensation, lease rent and transfer charges, and refusal of permissions. They are generally public law matters, challenged by writ petitions in the Allahabad High Court, or under the authorities' own procedures, rather than by arbitration.
The High Court has decided many such cases, including those involving stalled real estate projects and the rights of homebuyers and developers. Writ petitions should focus on the public law grounds, and be filed promptly, since delay can defeat relief.
Prayagraj's own businesses
Prayagraj has its own business community in trading, construction, education, healthcare and agro-processing. For arbitrations seated in Prayagraj, Section 9 and Section 34 petitions go to the commercial court in the Prayagraj district courts, and MSME suppliers in the district approach the UP council notified for the Prayagraj region. Commercial suits go to the Prayagraj commercial court after pre-institution mediation. We assist Prayagraj businesses through associate counsel, with our team handling the preparation.
Section 11 practice at Prayagraj
Section 11 applications in the Allahabad High Court follow the limited scrutiny approach after In re Interplay (2023) and SBI General Insurance v Krish Spinning (2024). The court checks whether an arbitration agreement exists and leaves most other questions to the tribunal. In contracts with UP government departments or authorities, the court will consider whether a unilateral appointment clause is valid after CORE (2024), and can appoint a neutral arbitrator.
Enforcing awards in UP
Awards can be executed in any court where the debtor has assets (Sundaram Finance v Abdul Samad, 2018). For UP debtors, execution is filed in the district court where the assets are, whether in Ghaziabad, Gautam Buddh Nagar, Meerut, Lucknow, Kanpur or elsewhere. Against UP government departments, Section 82 of the CPC requires a period for the government to satisfy the decree before execution.
Working with us on Prayagraj matters
We meet clients at our Vaishali or Dwarka offices or by video. Associate counsel in Prayagraj handle filings and routine appearances, and our team attends key hearings in person or by video. For NCR clients, most matters can be handled without travel to Prayagraj. We agree a budget, including associate counsel fees, at the start.
Commercial appeals from Ghaziabad and Noida
Appeals from the Ghaziabad and Gautam Buddh Nagar commercial courts, against orders on Section 9 and Section 34 petitions and in commercial suits, go to the commercial appellate division of the Allahabad High Court at Prayagraj within 60 days. The appellate court's scope in Section 37 appeals is no wider than the Section 34 court's (Jan De Nul, 2026), and interference with discretionary interim orders is limited. Apply for certified copies promptly, and decide quickly whether there is a real appellate point.
Writs against UP government departments
Contractors and suppliers to UP government departments sometimes face withheld payments, arbitrary terminations or blacklisting without a hearing. Writ petitions in the Allahabad High Court are available for public law issues, while contractual claims go to arbitration where the contract provides. Courts have quashed blacklisting orders made without a show-cause notice and fair hearing. Frame the writ around the public law element, and act promptly.
Lucknow Bench matters
For businesses in Lucknow, Ayodhya, Bahraich and other districts assigned to the Lucknow Bench, Section 11 applications, appeals and writs go to the Bench at Lucknow. Check the current list of districts under the High Court's rules before filing, since filing at the wrong seat leads to delay. We work with associate counsel at Lucknow for such matters.
UP MSME councils
Uttar Pradesh has councils notified for different regions or districts. An MSME supplier files before the council notified for the district where it is located, through the MSME ODR portal. For Ghaziabad and Gautam Buddh Nagar suppliers, that is the council notified for those districts. Challenges to council awards go to the commercial court under Section 34, with the 75% deposit, and only exceptionally to the High Court by writ.
UP state undertakings and authorities
Contracts with UP state undertakings, such as the industrial development authority UPSIDA, the power corporation and its distribution companies, and the state's construction corporations, often contain arbitration clauses, some with departmental appointment provisions. After CORE (2024), contractors can seek neutral appointments under Section 11 in the Allahabad High Court. Disputes about allotments and leases with UPSIDA are generally public law matters for writs.
Execution against UP government bodies
Awards against UP government departments are executed subject to Section 82 of the CPC, which allows the government time to satisfy the decree. Awards against state corporations that are companies are executed like other decrees. If a UP body challenges an award, press for a deposit as a condition of any stay, following Pam Developments (2019), and apply to withdraw it against security.
