Ghaziabad is one of the oldest industrial districts in the National Capital Region, with engineering, steel, packaging, chemicals, electrical goods and food processing units in areas such as Sahibabad, Loni, Meerut Road, Bulandshahr Road and Kavi Nagar, alongside fast-growing residential and commercial districts like Vaishali, Indirapuram and Raj Nagar Extension. Its businesses supply buyers across India and buy from suppliers everywhere, and their contracts often contain arbitration clauses.
This page is for Ghaziabad businesses and individuals with arbitration or commercial disputes, and for Delhi businesses whose contracts are seated in Ghaziabad. Our office is in Vaishali, close to the Ghaziabad courts and to Delhi. In short: Section 9 urgent relief and Section 34 challenges for Ghaziabad-seated arbitrations go to the commercial court at the Ghaziabad district courts, at any value. Appointments under Section 11 and appeals go to the Allahabad High Court at Prayagraj. Ghaziabad MSME suppliers file delayed payment claims before the UP council for their district.
If your contract names Delhi as the seat, the Delhi courts apply even though you are in Ghaziabad. We check the clause first.

Ghaziabad's courts and forums for arbitration
Because the Allahabad High Court has no original civil jurisdiction, the "Court" for Ghaziabad-seated arbitrations under Section 2(1)(e) is the commercial court at the Ghaziabad district courts. It hears Section 9 petitions, Section 34 challenges and Section 29A applications, whatever their value, and executes decrees and awards against assets in the district. See Ghaziabad and Noida commercial courts.
For appointments of arbitrators under Section 11, and appeals from the commercial court under Section 37, the forum is the Allahabad High Court at its principal seat in Prayagraj, which covers Ghaziabad. See Allahabad High Court.
Companies registered in Ghaziabad come under the NCLT Allahabad bench for insolvency and company law matters. MSME suppliers located in Ghaziabad approach the UP Micro and Small Enterprises Facilitation Council notified for the district, through the online portal. Pre-institution mediation for commercial suits is handled by the District Legal Services Authority, Ghaziabad.

Disputes we commonly see in Ghaziabad
Ghaziabad's manufacturers often supply large buyers in Delhi, Noida and across India, and their most common disputes are unpaid invoices and disputed quality claims. Many are registered micro or small enterprises, and the UP council route, with compound interest at three times the bank rate, often recovers more than an arbitration under the buyer's terms. Ghaziabad's builders and contractors face construction and fit-out disputes in residential projects in Raj Nagar Extension, Crossings Republik and along NH-24. Transporters and fleet owners on the Meerut and Hapur roads face vehicle finance arbitrations.
Ghaziabad also has many traders and distributors supplying Delhi's wholesale markets, whose disputes turn on credit periods, returns, and security deposits. For them, a combination of a legal notice, a summary suit or cheque bounce complaint, and arbitration where the contract has a clause, is often the practical route.
Ghaziabad seat or Delhi seat?
Many Ghaziabad businesses sign contracts that name Delhi as the seat, either because the counterparty is in Delhi or because Delhi is seen as a neutral and well-served seat. Others name Ghaziabad. The answer decides where the court work happens.
With a Delhi seat, Section 9 and 34 petitions go to Delhi courts, the High Court above ₹2 crore and the district commercial courts below, and Section 11 goes to the Delhi High Court. With a Ghaziabad seat, the Ghaziabad commercial court and the Allahabad High Court apply. A clause that names only a "venue" can lead to argument, so we read it carefully against J&K Economic Reconstruction Agency v Rash Builders (April 2026), which emphasised that the seat's courts have exclusive jurisdiction. Our Vaishali office is close to both sets of courts, which helps whichever applies.
Laws and rules that apply
The main law for Ghaziabad-seated arbitrations.
Commercial court at Ghaziabad and appeals.
UP council claims for Ghaziabad suppliers.
Execution against assets in Ghaziabad.
NCLT Allahabad for UP-registered companies.
A Sahibabad unit and a Delhi buyer
Here's a made-up example. A micro enterprise in Sahibabad making electrical panels supplied panels worth ₹31 lakh to a Delhi contractor for a hospital project. The purchase order had an arbitration clause seated in Delhi, and 60 days' credit. The contractor paid ₹9 lakh and then stopped, citing delays in its own payments from the hospital.
The enterprise was registered on Udyam before the supplies. We advised the UP council route rather than arbitration under the PO, because the council could decide the claim despite the Delhi arbitration clause, and the statutory interest ran from day 46, not day 60. The claim was filed on the portal before the council for Ghaziabad.
At conciliation, the contractor agreed to pay the principal in three monthly instalments and a reduced amount towards interest. The settlement was recorded. The enterprise avoided a Delhi arbitration altogether.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Vaishali (Ghaziabad) and Dwarka (New Delhi). This is what you can expect:
- Local office: in Vaishali, close to the Ghaziabad courts.
- High Court coordination: Section 11 and appeals at Prayagraj.
- MSME focus: many Ghaziabad clients are micro and small suppliers.
- Delhi access: for contracts seated in Delhi.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes Ghaziabad businesses make
- Assuming a Ghaziabad business's dispute is heard in Ghaziabad when the seat is Delhi
- Filing a Section 34 petition in the High Court
- Not registering on Udyam before supplying
- Ignoring NBFC arbitration letters
- Filing at Lucknow instead of Prayagraj
- Missing the 60-day commercial appeal period
NBFC and vehicle loan arbitrations in Ghaziabad
Ghaziabad has a large number of transport businesses, small traders and self-employed borrowers with loans from NBFCs and small finance banks. Many of these loans carry arbitration clauses, and many borrowers first learn of an arbitration when a recovery agent arrives or a bank account is frozen.
The law is on the borrower's side where the process was one-sided. Since Perkins Eastman (2019) and CORE (2024), a lender cannot appoint a sole arbitrator on its own. In Arth Micro Finance v Shivalik Small Finance Bank (September 2026), the Supreme Court set aside freezing orders and declared an arbitration of no legal effect where the lender could not prove the borrowers had consented to its tribunal. If you are in Ghaziabad and have received a loan arbitration notice, award or freezing order, act quickly. See bank and NBFC loan arbitration, vehicle loan arbitration and remedies against a one-sided award.
Construction and real estate around Ghaziabad
Ghaziabad's residential growth along NH-24, in Raj Nagar Extension, Crossings Republik, Indirapuram and Vaishali has produced construction and real estate disputes of every kind: contractors claiming unpaid running bills and refund of retention, developers claiming delay damages, land owners and developers disputing collaboration agreements, and buyers seeking possession or refunds.
Contractor and developer disputes usually go to arbitration under the contract. Land owner and developer disputes depend on the agreement, which may or may not have a clause. Buyers' claims often go to UP RERA, consumer forums, or, where the developer is insolvent, the NCLT. Choosing one forum per claim, and avoiding contradictory proceedings, is important. See construction arbitration and real estate arbitration.
Visiting our Vaishali office
Our Vaishali office is convenient for clients from Ghaziabad, Noida, Indirapuram and East Delhi. Bring your contract, the notice or award, and the key correspondence to the first meeting; if you cannot visit, send them on WhatsApp or email and we will review them and call you. Many matters can be handled entirely remotely, with in-person meetings only for important decisions or hearings.
Execution against Ghaziabad debtors
Many of our Ghaziabad matters end in execution. A creditor holding an award or decree against a Ghaziabad business can file for execution in the commercial court at Ghaziabad if the debtor's assets are there. For arbitral awards, the Supreme Court in Sundaram Finance v Abdul Samad (2018) allows filing directly where the assets are, without first transferring the award from the seat court.
Bank accounts are the first target. Many Ghaziabad businesses bank with branches in Raj Nagar, Vaishali, Indirapuram, Sahibabad and along the Meerut Road, and attachment orders on those branches are routine. Industrial plots in UPSIDC areas, warehouses and vehicles are other common assets. Receivables owed to the debtor by its own customers can be attached by garnishee orders, which often brings quick settlement because it affects the debtor's relationships.
For debtors, an execution petition is the moment to negotiate seriously. Courts often record payment plans backed by post-dated cheques or security, and lift attachments once the plan is in place.
MSME suppliers in Ghaziabad: a closer look
Ghaziabad has a dense network of micro and small manufacturers and service providers. Before filing a delayed payment claim, check three things. First, your Udyam classification: with the revised thresholds from 1 April 2025, some units that were small became micro, and some medium units became small; the classification at the time of the supplies matters. Second, your registration date compared with the supply dates. Third, the buyer's correct legal name and registered office, because many buyers trade under brand names.
The UP council for your district sits within the state's industries department set-up, and since 2025 cases are filed online through the MSME ODR portal. Online conciliation has made it much easier for Ghaziabad suppliers to pursue buyers in other states without travelling. If the buyer is a Central Public Sector Enterprise, note that from 15 October 2026 CPSEs must settle MSME invoices through TReDS, which may speed up payment on accepted invoices.
Cheque bounce cases alongside arbitration
In Ghaziabad's trading and manufacturing community, post-dated cheques are often given as security for credit. When they bounce, a complaint under Section 138 of the Negotiable Instruments Act is filed in the court where the payee's bank branch is located, which for Ghaziabad businesses is usually a magistrate's court in Ghaziabad. The strict timelines apply: notice within 30 days of the return memo, 15 days for the drawer to pay, and the complaint within one month after that.
A cheque bounce complaint can run alongside an arbitration or MSME claim for the full account. The criminal case creates personal pressure on the drawer; the civil or council case recovers the debt with interest. Settlements should cover both. See cheque bounce case.
Companies registered in Ghaziabad and the NCLT
Companies with registered offices in Ghaziabad come under the NCLT Allahabad bench for insolvency petitions, oppression and mismanagement petitions and other company law matters. For Ghaziabad creditors, this means that an insolvency application against a Ghaziabad company is filed at Prayagraj, not Delhi, even if the creditor is in Delhi. For Ghaziabad shareholders in disputes with co-promoters, the oppression petition goes to the Allahabad bench too.
Before filing, check the company's registered office in the MCA records; many Ghaziabad businesses are registered in Delhi, and vice versa. The NCLT bench depends on the state of the registered office, not where the factory or office is located. See NCLT and NCLAT.
Choosing between the MSME council and arbitration
For a Ghaziabad micro or small supplier with unpaid invoices and a contract containing an arbitration clause, there are two possible routes. The council route offers low cost, statutory interest at three times the bank rate, and the 75% deposit rule for challenges; but registration timing objections and works contract arguments can arise, and councils can be slow. Arbitration under the contract offers a tribunal chosen by the parties or the court, but involves arbitrators' fees and an appointment process.
For most registered suppliers with clear invoices and delivery records, the council is the better choice. For large or complex claims, or where registration post-dates many of the supplies, arbitration may be preferable. We compare both for your specific case.
