The International Chamber of Commerce (ICC) administers more international arbitrations than almost any other institution, and Indian parties regularly appear before it. ICC clauses are common in infrastructure, energy, defence, technology and manufacturing contracts with foreign companies, and in contracts drafted by multinational groups. The ICC International Court of Arbitration, which administers the cases, is not a court in the ordinary sense; it supervises the process, confirms arbitrators and scrutinises draft awards.
This page is for Indian businesses with ICC clauses or facing ICC arbitrations. In short: ICC cases run under the ICC Rules 2021; distinctive features include the terms of reference, the case management conference and the ICC Court's scrutiny of the draft award, which improves the quality of awards; an expedited procedure applies automatically to lower-value disputes under recent agreements; Indian courts can support a foreign-seated ICC arbitration under Section 9; and ICC awards are enforced in India as foreign awards, or as domestic awards if the seat is in India.
ICC arbitration is thorough and well regarded, but it is not cheap. Fees are on the ICC's scale in US dollars, and the process for a large case can take two years or more.

Key features of ICC arbitration
ICC Court
Supervises the arbitration, confirms or appoints arbitrators and decides challenges.
Terms of reference
A document fixing the parties, claims, issues and procedure early in the case.
Case management conference
Early planning of the timetable and procedure.
Scrutiny of awards
The ICC Court reviews the draft award for form and may draw attention to substance.
Expedited procedure
Sole arbitrator, shortened timelines, award usually within six months of the case management conference.
Emergency arbitrator
Urgent relief before the tribunal is constituted, unless the parties opted out.
How an ICC arbitration differs
Two features set ICC arbitration apart. First, the terms of reference: soon after the tribunal receives the file, it draws up a document summarising the parties' claims and relief sought, listing the issues to be decided, and recording procedural rules. Once signed, new claims outside the terms of reference require the tribunal's permission. This discipline helps keep the case focused.
Second, the scrutiny of the award. Before signing an award, the tribunal must submit it in draft to the ICC Court, which may lay down modifications as to form and, without affecting the tribunal's liberty of decision, may draw its attention to points of substance. This reduces the risk of errors and gaps that could later be used to challenge the award. Many practitioners see it as one reason ICC awards are well regarded by courts, including in India.
How an ICC arbitration runs
Request for arbitration
Filed with the ICC Secretariat with the filing fee.
Answer
The respondent answers within 30 days, extendable, with any counter-claims.
Constitution of the tribunal
By the parties' nominations, confirmed by the ICC Court, or by the Court's appointment.
Advance on costs
Fixed by the ICC Court and usually paid equally by the parties.
Terms of reference and case management conference
Issues, procedure and timetable settled early.
Submissions, evidence and hearing
Written submissions, documents, witness and expert evidence, and a hearing.
Scrutiny and award
Draft award reviewed by the ICC Court, then signed and notified.

ICC arbitration with an Indian seat
Parties can choose ICC rules with a seat in India, often New Delhi or Mumbai. The award is then an Indian award, subject to challenge under Section 34 in the Indian court of the seat. If both parties are Indian, it is a domestic award, and Section 29A timelines apply; if one party is foreign, it is an international commercial arbitration seated in India, with the 12-month target in Section 29A(1) only advisory.
ICC with an Indian seat appeals to foreign parties who want ICC administration but accept Indian courts' supervision, and to Indian public sector companies dealing with foreign contractors. Indian courts have upheld such clauses, and the ICC has an active Indian user base and regional presence.
Enforcing ICC awards in India
An ICC award made in a New York Convention country notified by India, such as France, the United Kingdom, Singapore or Switzerland, is a foreign award under Part II. Enforcement is by petition to the High Court with jurisdiction over the assets, which can refuse enforcement only on the narrow grounds in Section 48. Indian courts have enforced many ICC awards, and the Supreme Court has held that enforcement objections are not an opportunity to review the merits.
An ICC award made in India is enforced as a domestic award under Section 36, subject to any Section 34 challenge and stay. The ICC's scrutiny process does not change the Indian law position, but a well-reasoned award is harder to challenge on grounds such as lack of reasons or failure to deal with issues.

An ICC award against an Indian EPC company
Here's a made-up example. A European equipment supplier obtained an ICC award seated in London for EUR 2.1 million against an Indian EPC company for unpaid equipment invoices. The Indian company argued in enforcement proceedings in the Delhi High Court that the tribunal had refused an adjournment for a key witness, so it was unable to present its case under Section 48(1)(b).
We acted for the Indian company and examined the record. It showed that the tribunal had granted two earlier adjournments and allowed the witness to give evidence by video, which the company had declined. We advised that the objection was unlikely to succeed and that a negotiated payment plan would reduce interest and costs. The company settled at a reduced amount on agreed instalments, with the enforcement petition withdrawn on payment.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with counsel abroad where needed. This is what you can expect:
- Indian law input: on contracts governed by Indian law in ICC cases.
- Section 9 support: urgent relief against assets in India.
- Enforcement handling: filing or resisting enforcement petitions.
- Honest advice: whether a Section 48 objection has real prospects.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in ICC cases
- Not paying the advance on costs, which can stall your claim
- Raising new claims after the terms of reference without permission
- Ignoring the automatic expedited procedure in recent contracts
- Assuming an ICC award cannot be enforced in India
- Filing a Section 34 challenge against a foreign-seated ICC award
- Not budgeting for USD costs and counsel abroad
The advance on costs
The ICC Court fixes an advance on costs to cover the arbitrators' fees and expenses and the ICC's administrative expenses, usually payable in equal shares by the claimant and respondent. If the respondent does not pay its share, the claimant must pay it to keep the case going, and can recover it in the award. If neither pays, the claims may be considered withdrawn.
For Indian parties, paying in US dollars requires planning under the foreign exchange rules, and banks may require documents. Separate advances can be fixed for claims and counter-claims, which matters when the counter-claim is large. Budget for the advance at the outset, and for possible increases as the case proceeds.
Choosing arbitrators in ICC cases
Under the ICC Rules, each party usually nominates a co-arbitrator in a three-member tribunal, and the co-arbitrators or the ICC Court choose the president. Every nominee must sign a statement of acceptance, availability, impartiality and independence, disclosing any facts that might call their independence into question. The ICC Court confirms nominees, and the other party may object.
For an Indian party, nominating an arbitrator who understands Indian law and business can be valuable, particularly if the contract is governed by Indian law. The ICC Court applies its own standards of independence, which are strict. The ICC also publishes the names and nationalities of arbitrators in its cases, which adds transparency.
Expedited procedure in practice
The ICC expedited procedure provisions apply automatically to arbitrations where the amount in dispute does not exceed the threshold in the rules for the date of the arbitration agreement, unless the parties opted out or the ICC Court decides it is inappropriate. The case is usually heard by a sole arbitrator, even if the clause provides for three, there are no terms of reference, and the award is due within six months of the case management conference.
The tribunal may decide the case on documents alone, without a hearing, and may limit the number and length of written submissions. For an Indian party with a straightforward claim against a foreign counterparty, the expedited procedure can deliver an award quickly and at lower cost. Check the date of your arbitration agreement and the applicable threshold.
Document production and the IBA Rules
ICC tribunals often take guidance from the IBA Rules on the Taking of Evidence in International Arbitration, which provide for limited, targeted document production rather than the broad disclosure common in some common law systems. Requests must identify specific documents or narrow categories and explain their relevance and materiality. The tribunal decides disputed requests, often using a Redfern schedule.
Indian parties used to the CPC's discovery provisions should prepare for this different approach: produce documents relied on with the submissions, keep internal documents organised in case they are requested, and frame requests to the other side precisely.
ICC Mediation and settlement
The ICC also offers mediation under its Mediation Rules, administered by the ICC International Centre for ADR. Parties in an ICC arbitration can pause the arbitration to mediate, and many cases settle this way. A settlement can be recorded as an award by consent, which is enforceable like any award.
For Indian parties, mediation can save significant costs in a dispute that would otherwise run for years in a foreign seat. Consider mediation early, especially once each side has seen the other's written case and the main documents.
Indian public sector companies and ICC
Indian public sector companies sometimes enter ICC arbitrations under contracts with foreign suppliers and contractors. Their internal approval processes for paying advances, appointing counsel and settling cases can be slow, which can cause delays in the arbitration. Foreign counterparties sometimes seek orders or costs as a result. Planning approvals in advance, and keeping the tribunal informed of timelines, helps avoid procedural problems.
Public sector companies also face scrutiny of settlements by audit and vigilance bodies, which can make them reluctant to settle. The Ministry of Finance's 2024 guidelines encourage negotiated settlement and mediation where appropriate, which may help such companies justify settlement of strong claims against them.
Drafting an ICC clause
The ICC's standard clause reads, in substance: "All disputes arising out of or in connection with the present contract shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules." Parties should add the seat, the number of arbitrators, the language and the governing law of the contract. Where an Indian party is involved, consider whether to keep Section 9 relief in India, which is available for a foreign seat unless the parties exclude it, and whether the expedited procedure or emergency arbitrator provisions should be excluded.
Indian parties sometimes negotiate for an Indian seat with ICC rules, which gives a domestic or Indian-seated international award supervised by Indian courts. Foreign parties often prefer a neutral seat such as Singapore, London, Paris or Geneva. Agree the seat clearly; an unclear seat invites satellite litigation before the arbitration even starts.
Hearings and the use of time
ICC hearings in large cases often run for a week or more, with cross-examination of fact witnesses and experts. Tribunals commonly use a chess-clock system, allocating each side a fixed amount of time for its examinations and submissions. Preparation is decisive: a core bundle of key documents, a cross-examination plan focused on the issues in the terms of reference, and written opening and closing submissions.
For Indian parties, witnesses unused to international arbitration should be prepared on the process, which is generally more conversational than Indian court cross-examination, while staying within what is ethically permitted. Interpreters may be needed for witnesses more comfortable in Hindi or another language.
Costs at the end of an ICC case
The ICC Rules give the tribunal discretion to allocate the costs of the arbitration, including the ICC's fees, the arbitrators' fees and the parties' legal costs, taking into account the outcome and the parties' conduct, including whether they conducted the arbitration efficiently. Unsuccessful parties often bear a substantial share of the successful party's costs. Keep detailed records of legal fees and expenses throughout, since a well-supported costs submission is more likely to be accepted.
