Jaipur is close to Delhi NCR, and the business links between them are strong. NCR developers and contractors build hotels, housing and commercial projects in Jaipur; NCR solar developers and EPC contractors build plants across Rajasthan; NCR buyers source marble, stone, textiles, handicrafts and jewellery from Jaipur and other Rajasthan cities; and Jaipur businesses sell into NCR. Many of their contracts choose Jaipur as the seat of arbitration.
This page is for Delhi NCR businesses with Rajasthan counterparties or Jaipur-seated arbitrations, and for Jaipur businesses with NCR disputes. We handle Rajasthan matters from Delhi NCR, with associate counsel in Jaipur. In short: for domestic arbitrations seated in Jaipur, Section 9 and Section 34 petitions go to the Jaipur commercial court, because the Rajasthan High Court has no ordinary original civil jurisdiction for commercial matters; Section 11 applications, international matters and appeals go to the High Court, at the Jaipur Bench or Jodhpur depending on the district; companies registered in Rajasthan come under the NCLT Jaipur bench; and MSME suppliers file before the council of their own location.
Jaipur's closeness to Delhi makes in-person hearings practical when they matter.

Construction projects in Jaipur
NCR contractors building in Jaipur face familiar disputes: delays caused by late drawings, approvals and site handover; extra and varied work; withheld final bills and retention; and liquidated damages. The contract's dispute clause, often with a Jaipur seat, decides the forum. Keep the hindrance register, correspondence and measurement records from the start, since these decide most claims. See construction arbitration.
Laws and rules that apply
Sections 2(1)(e), 9, 11, 34 and 36.
Commercial courts in Rajasthan.
Council jurisdiction by supplier's location.
Section 86(1)(f) for PPA disputes.
NCLT Jaipur for Rajasthan companies.
A Delhi interior contractor and a Jaipur hotel
Here's a made-up example. A Delhi interior fit-out contractor completed the interiors of a boutique hotel in Jaipur under a contract seated in Jaipur. The hotel owner withheld ₹96 lakh, alleging defects and delay, and refused to appoint an arbitrator.
We filed a Section 11 application at the Rajasthan High Court's Jaipur Bench through local counsel, and the court appointed a retired district judge. Our team attended the evidence hearing in Jaipur in person, a short trip from Delhi, while other hearings were online. The arbitrator found that most of the alleged defects had been fixed during the defects period, and awarded the contractor ₹81 lakh with interest.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with associate counsel in Jaipur. This is what you can expect:
- Project experience: construction, solar and supply disputes.
- Forum accuracy: Jaipur Bench or Jodhpur, High Court or district court.
- Close coordination: Jaipur is a short trip for key hearings.
- Cost clarity: associate counsel fees agreed in advance.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in Delhi–Rajasthan disputes
- Filing a domestic Section 34 petition in the High Court
- Filing at Jodhpur for a Jaipur Bench matter, or the reverse
- Taking PPA disputes directly to arbitration
- Not keeping hindrance registers on Rajasthan projects
- Missing the NCLT Jaipur bench for Rajasthan companies
- Assuming the project location decides the seat
Solar EPC and O&M disputes
Many solar plants in Rajasthan are developed by NCR-based companies and built by NCR-based EPC contractors, with contracts seated in Delhi. Disputes concern delays in land and connectivity, performance ratio shortfalls, module and inverter defects, and O&M availability. Where the seat is Delhi, Delhi courts supervise; where it is Jaipur or Jodhpur, Rajasthan courts do. Generation and SCADA data, and an independent engineer's analysis, usually decide performance disputes. See power and energy arbitration.
Marble, stone and handicraft suppliers
NCR builders, retailers and exporters source marble, granite, sandstone, handicrafts and furniture from Rajasthan. Disputes concern quality and finish, breakage in transit, short supply and payment. Many suppliers are MSMEs who can file before the Rajasthan council. Buyers should inspect on receipt and record objections in writing within 15 days, with photographs, to protect their position.
NCLT Jaipur
The NCLT Jaipur bench hears insolvency applications and company matters for companies registered in Rajasthan. NCR creditors filing against a Rajasthan company file there. Hearings are often by video, which reduces travel. See NCLT and NCLAT.
Enforcing against Rajasthan assets
An award holder can file execution in the Rajasthan district court with jurisdiction over the debtor's assets, even if the arbitration was seated in Delhi (Sundaram Finance v Abdul Samad, 2018). For project companies, the plant itself may be subject to lenders' security, so receivables and bank accounts are often the practical targets.
Working with us on Jaipur matters
We meet clients at our Dwarka or Vaishali offices, in Jaipur when needed, or by video. Associate counsel in Jaipur handle filings and routine appearances, and our team attends key hearings in person, since the distance from Delhi is short. We agree a budget, including associate counsel fees, at the start.
Hospitality and tourism contracts
Jaipur's hotel and tourism sector produces disputes under hotel management agreements, franchise agreements with hotel brands, construction and fit-out contracts, and leases of heritage properties. Hotel management agreements usually have arbitration clauses, sometimes with foreign seats where the brand is international. Disputes concern performance tests, fees, termination and brand standards. Read the termination and performance clauses carefully before acting.
Section 9 relief in Jaipur
For Jaipur-seated domestic arbitrations, Section 9 petitions go to the Jaipur commercial court; for Delhi-seated arbitrations, the Delhi court can grant relief against a Rajasthan party, enforceable in Rajasthan. In construction disputes, common orders include restraining removal of the contractor's equipment from site, preserving materials, and protecting against bank guarantee invocation on the narrow grounds. See commercial injunction.
Rajasthan MSME council
Suppliers located in Rajasthan file before the Rajasthan council through the MSME ODR portal. NCR buyers of Rajasthan MSME goods, such as marble, textiles and handicrafts, may face such references. NCR MSME suppliers to Rajasthan buyers file before their own state's council. Section 16 interest at three times the bank rate, compounded monthly, applies. See MSME delayed payment.
Jodhpur and western Rajasthan
For matters arising in Jodhpur, Barmer, Bikaner, Jaisalmer and other districts under the principal seat, Section 11 applications, appeals and writs go to the Rajasthan High Court at Jodhpur. Many solar projects and stone quarries are in these districts. Where a contract is seated in one of them, the district commercial court there supervises the arbitration. We work with associate counsel at Jodhpur for such matters.
Jewellery and gemstones
Jaipur is a major centre for coloured gemstones and jewellery. NCR retailers and exporters dealing with Jaipur firms face disputes over credit, consignment and memo goods, quality and certification, and export orders. Many transactions are documented by memos and invoices rather than detailed contracts. Keep records of goods given on approval and their return, and certification documents, since these are usually the main evidence.
Real estate in Jaipur
Jaipur's real estate market includes township projects, commercial complexes and joint development arrangements with landowners. Disputes between developers, landowners, contractors and investors are arbitrable where the agreements contain clauses; homebuyer complaints usually go to the Rajasthan Real Estate Regulatory Authority or consumer commissions. Disputes about Jaipur Development Authority approvals and land conversions are public law matters. See real estate arbitration.
Mining services and transport
Contracts for mining services, overburden removal, mineral transport and crushing with Rajasthan lease holders and public undertakings often involve NCR contractors and equipment financiers. Disputes concern measurement of quantities, rate revisions, idle time and termination. The lease holder's disputes with the state over the mining lease are public law matters, but contractual disputes between the lease holder and its contractors are arbitrable.
Choosing a seat for NCR–Rajasthan contracts
Contracts between NCR businesses and Rajasthan parties often say only that arbitration will be "at Jaipur" or "at New Delhi". After BGS SGS Soma (2019), a sole named place is usually treated as the seat, which decides whether challenges go to the Rajasthan High Court at Jaipur or to courts in Delhi. For solar EPC and supply contracts where the project is in western Rajasthan but the parties are in NCR, a Delhi seat with hearings by video is often convenient for both sides. Whatever you choose, write "the seat of arbitration shall be" the chosen city, and keep the jurisdiction clause consistent with it. A micro or small supplier's council claim follows the supplier's location regardless of the seat. See seat vs venue in arbitration.
Pre-institution mediation in Rajasthan
If a dispute with a Rajasthan party is headed to a commercial court rather than arbitration, and it is a commercial dispute of ₹3 lakh or more with no genuine urgency, pre-institution mediation under Section 12A must be attempted first through the Legal Services Authority designated for the district where the suit will be filed. The process usually takes up to three months, and the time is excluded for limitation. If the other side does not attend, a non-starter report is issued and the suit can be filed. See is pre-litigation mediation mandatory.
