The Mumbai Centre for International Arbitration (MCIA) was set up in 2016 as an independent arbitral institution in India's commercial capital. It was created to give Indian and foreign businesses a home-grown institution with international standards, and has built a caseload across banking and finance, shipping, real estate, infrastructure, media and technology. Its rules are modelled on leading international institutions, and it maintains a panel of Indian and foreign arbitrators.
This page is for businesses with MCIA clauses, or choosing an institution for a contract with Mumbai links. In short: MCIA administers domestic and international arbitrations under its rules; it offers emergency arbitrator and expedited options, appoints arbitrators if the parties do not agree, and publishes its fees; arbitrations are usually seated in Mumbai, so the Bombay High Court has supervisory jurisdiction; and an MCIA award with an Indian seat is an Indian award, enforceable and challengeable under Part I.
We are based in Delhi NCR and handle MCIA matters with associate counsel in Mumbai, combining our arbitration experience with local court support.

International-standard rules, with provisions suited to domestic cases.
Appointments
The centre appoints if the parties or co-arbitrators cannot agree.
Emergency arbitrator
Urgent relief before the tribunal is formed.
Expedited procedure
For smaller or simpler disputes, by agreement or within the rules' limits.

Why parties choose MCIA
Mumbai is the home of many of India's banks, financial institutions, shipping companies, media houses and large corporates, and of a commercial bar with long arbitration experience. The Bombay High Court has a well-established commercial division and has decided many leading arbitration cases. For contracts with a Mumbai connection, an MCIA clause with a Mumbai seat offers an institution and a supervising court that are both familiar with commercial disputes.
For foreign parties wary of ad hoc arbitration in India, MCIA provides international-standard administration, independent appointments and cost control, while keeping the arbitration in India, where the assets often are. For Indian parties, it avoids the foreign currency costs and travel of a foreign seat.

Drafting an MCIA clause
A model approach: "Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration Rules of the Mumbai Centre for International Arbitration. The seat of arbitration shall be Mumbai, India. The tribunal shall consist of [one/three] arbitrator(s). The language of the arbitration shall be English."
Add the governing law of the contract separately. If you want to exclude or include the emergency arbitrator provisions or the expedited procedure, say so. If one party is foreign and a neutral presiding arbitrator matters, consider providing for a presiding arbitrator of a nationality different from the parties'. Avoid clauses that let one party alone appoint the arbitrator. See arbitration clause drafting.
The Bombay High Court's role
For an MCIA arbitration seated in Mumbai, the Bombay High Court, on its original side, or the commercial court in Mumbai for lower-value matters, is the "Court" under Section 2(1)(e) for domestic arbitrations. For international commercial arbitrations seated in Mumbai, the Bombay High Court has jurisdiction under Section 2(1)(e)(ii). This court hears Section 9 applications for interim relief, Section 29A applications in domestic cases, and Section 34 challenges to the award.
After BGS SGS Soma (2019), the choice of seat confers exclusive jurisdiction on the courts of the seat. So a party in Delhi cannot challenge a Mumbai-seated MCIA award in Delhi. Plan for proceedings in Mumbai, with associate counsel there. See Bombay High Court arbitration lawyer.

A financing dispute under MCIA
Here's a made-up example. A Noida technology company had raised venture debt from a Mumbai lender under a loan agreement with an MCIA clause seated in Mumbai. After a missed payment, the lender sought to enforce its security over the company's receivables. The company disputed the default, arguing that the lender had wrongly refused a scheduled disbursement that would have funded the payment.
The lender applied for an emergency arbitrator, who granted a limited order requiring the company to keep receivables in a designated account. We represented the company. In the main arbitration, the tribunal found that the lender had breached its disbursement obligation, reduced the claimed default interest, and directed a revised repayment schedule. Because the seat was Mumbai, interim court applications were handled in the Bombay High Court with associate counsel there.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), and associate counsel in Mumbai. This is what you can expect:
- Rules-led procedure: filings and timelines under the MCIA rules.
- Mumbai coordination: court applications through local counsel.
- Arbitrator assessment: careful choice of nominees.
- Cost control: focused pleadings and hearings.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in MCIA cases
- Filing court proceedings in Delhi for a Mumbai-seated arbitration
- Not checking MCIA's current fee schedule and deposits
- Ignoring the emergency arbitrator option when urgency exists
- Leaving the seat unclear in the clause
- Missing the Section 34 limit in the Bombay High Court
- Assuming a foreign seat is implied because the institution is "international"
Emergency relief at MCIA
MCIA's rules allow a party needing urgent interim relief before the tribunal is constituted to apply for an emergency arbitrator. The centre appoints an emergency arbitrator quickly, who sets a short timetable, hears both sides where possible, and decides the application. The order binds the parties and, for a Mumbai-seated arbitration, is enforceable in India as an order of the tribunal after Amazon v Future Retail (2021).
The applicant must usually start the main arbitration within a short time if it has not already done so. The emergency order can be reviewed, varied or discharged by the main tribunal once constituted. Compare the emergency route with a Section 9 application in the Bombay High Court: the court can bind third parties such as banks; the emergency arbitrator acts privately and often faster. See emergency arbitration.
Expedited procedure
MCIA's rules provide for an expedited procedure, available where the amount in dispute is below the threshold set in the rules, or where the parties agree, or in cases of exceptional urgency. Under it, the case is usually decided by a sole arbitrator, on a compressed timetable, with the award due within a short period of the tribunal's constitution. The tribunal may decide on documents alone.
For an Indian business with a clear claim, such as unpaid invoices backed by acceptance records, the expedited procedure can deliver an institutional award quickly and at proportionate cost. Ask for it in the notice of arbitration if it applies.
Financial services disputes
Many MCIA cases involve banks, NBFCs, investment funds and fintech companies: loan and security disputes, investment and shareholder agreements, structured products and asset management arrangements. These disputes often involve complex documents and expert evidence on valuation or market practice. Tribunals with finance experience, which the MCIA panel can supply, are valuable.
For regulated entities, some disputes may also involve the RBI or SEBI, whose regulatory jurisdiction cannot be displaced by arbitration. Contractual claims between the parties remain arbitrable, but enforcement actions and regulatory penalties are matters for the regulator.
Shipping and maritime disputes
Shipping contracts, such as charter parties and contracts of affreightment, traditionally choose London arbitration under LMAA terms. But Indian parties increasingly consider Indian seats for disputes with Indian counterparties, and MCIA has handled maritime matters. Admiralty claims, such as arrest of ships, are governed by the Admiralty (Jurisdiction and Settlement of Maritime Claims) Act, 2017, and remain matters for the High Courts with admiralty jurisdiction, including the Bombay High Court. An arbitration can proceed alongside an arrest to secure the claim.
Costs and recovery
MCIA tribunals decide costs under Section 31A of the Arbitration Act and the rules, generally following the principle that the unsuccessful party pays the successful party's reasonable costs, subject to conduct and the outcome of particular issues. Keep records of legal fees, expert fees and the institution's deposits, so that a costs claim can be supported at the end. Tribunals often ask for a statement of costs with supporting documents after the hearing.
Combining MCIA arbitration and mediation
MCIA also offers mediation services, and parties can agree to mediate before or during an arbitration. A settlement reached in mediation during an arbitration can be recorded as an award on agreed terms under Section 30, which is enforceable as a decree. Under the Mediation Act, 2023, a mediated settlement agreement reached outside an arbitration is also enforceable, once the relevant provisions apply. See mediation services.
Starting an MCIA case
An MCIA arbitration begins with a notice of arbitration filed with the centre and served on the respondent. It should identify the parties, the arbitration agreement and the rules, describe the dispute and the relief sought, estimate the amount in dispute, and nominate an arbitrator if the clause provides for three. The filing fee must be paid, and the centre then notifies the respondent and manages the next steps.
The respondent's response should raise any jurisdictional objection, any limitation defence and any counter-claim, and nominate its arbitrator if required. Under Section 16(2), a jurisdiction plea must be raised no later than the statement of defence, so raise it early.
Real estate and infrastructure disputes
Mumbai's real estate and infrastructure sectors produce many arbitrations: development agreements, redevelopment of housing societies, construction contracts, and infrastructure concessions. Some of these disputes involve parties who are bound by statutory regimes, such as RERA for homebuyers or the Maharashtra Co-operative Societies Act for housing societies, which may affect arbitrability or the forum for particular issues. Contractual disputes between developers, landowners, contractors and investors are generally arbitrable.
In redevelopment disputes between housing societies and developers, members who are not signatories may also have claims. The Bombay High Court has decided many Section 9 applications in such cases, for example to compel members to vacate for redevelopment, or to restrain a developer from creating third-party rights. See real estate arbitration.
Media, technology and entertainment
Mumbai is the centre of India's film, music and media industries, and disputes over production agreements, distribution rights, music licences and talent contracts are common. These contracts frequently contain arbitration clauses, and the disputes often involve intellectual property rights, revenue sharing and release schedules where time is critical. Emergency arbitration or urgent Section 9 relief can protect a release date or stop an unauthorised release.
As with other IP disputes, contractual claims are arbitrable, while questions of registration or validity binding the world are for the statutory forums. See IP licensing arbitration.
Practical tips for parties outside Mumbai
For businesses in Delhi NCR or elsewhere with Mumbai-seated MCIA arbitrations, much of the work can be done remotely. Pleadings and documents are filed electronically, case management conferences are often held by video, and many hearings can be online or hybrid. Court applications in the Bombay High Court need local counsel and attendance, though the High Court also allows video appearances in many matters.
Plan the budget for travel to Mumbai for key hearings, especially cross-examination of important witnesses, and for local counsel's fees. Agreeing a hybrid hearing protocol at the start reduces travel without compromising the evidence.
