Mumbai is where many of India's largest companies, banks, financial institutions, shipping lines, media houses and real estate developers are based. Delhi NCR businesses often contract with Mumbai counterparties, and many of those contracts choose Mumbai as the seat of arbitration, sometimes with the Mumbai Centre for International Arbitration (MCIA). Equally, Mumbai businesses often have suppliers, customers and projects in Delhi NCR.

This page is for Delhi NCR businesses with Mumbai counterparties or Mumbai-seated arbitrations, and for Mumbai businesses with disputes in NCR. We do not have our own office in Mumbai; we handle Mumbai matters from Delhi NCR, working with associate counsel in Mumbai for filings and appearances. In short: if your contract chooses a Mumbai seat, the Mumbai courts supervise the arbitration, and which Mumbai court depends on value after the 2023 change in the City Civil Court's jurisdiction; MCIA cases are run under its rules; companies registered in Maharashtra come under the NCLT Mumbai bench; and enforcement can be filed where the assets are, in Mumbai or elsewhere.

Most of the work, from strategy to drafting, can be done from Delhi. Local counsel handle filings and many hearings are by video.

Where your matter goes

Mumbai's courts and forums

For a domestic arbitration seated in Mumbai, Section 9 and Section 34 petitions go either to the Bombay High Court's commercial division or to the City Civil Court, depending on the value and the current pecuniary limits, which were raised by a 2023 amendment. For international commercial arbitrations seated in Mumbai, the High Court is the Court. Section 11 applications for domestic arbitrations seated in Maharashtra go to the Bombay High Court; for international ones, to the Supreme Court.

Companies registered in Maharashtra come under the NCLT Mumbai bench for insolvency and company matters. MSME suppliers located in Maharashtra approach the councils notified for their region. See Bombay High Court arbitration and MCIA arbitration.

Delhi NCR suppliers and Mumbai buyers

Many Delhi NCR manufacturers and service providers supply Mumbai companies. When a Mumbai buyer delays payment, an NCR supplier registered as a micro or small enterprise can file a claim before the MSME council of its own location, for example Uttar Pradesh or Haryana, not Mumbai, under Section 18(4). This is often the most effective route, with statutory interest at three times the bank rate.

For non-MSME suppliers, the contract's arbitration clause decides the route. Where the contract names a Mumbai seat, the arbitration and any court petitions are in Mumbai. Where it names Delhi, the Delhi courts supervise, even though the buyer is in Mumbai. Where the debt is large and undisputed and the buyer is a company, an IBC demand notice may also be considered, with any application before the NCLT Mumbai bench. See IBC demand notice.

Mumbai's specialist disputes

Media, finance and real estate

Mumbai's film, television and music industries produce disputes over production agreements, distribution rights, music licences and talent contracts, often needing urgent relief before a release. Its financial sector produces disputes under loan agreements, investment agreements, and fund documents. Its real estate sector, with many redevelopment projects, produces disputes between developers, housing societies, landowners and investors. Each has specialist practice in Mumbai, and local counsel's experience is valuable.

Illustration

A Noida supplier and a Mumbai retailer

Here's a made-up example. A Noida electronics accessories maker, registered as a small enterprise, supplied a Mumbai retail chain for two years. The chain stopped paying ₹78 lakh of invoices, citing slow sales. The supply agreement had an arbitration clause with a Mumbai seat.

Because the supplier was an MSME located in Uttar Pradesh, we filed a reference before the UP council notified for Gautam Buddh Nagar, despite the Mumbai arbitration clause, relying on Mahakali Foods (2022). The retail chain appeared through Mumbai counsel. At conciliation, it agreed to pay the invoices in four instalments with part of the statutory interest. The supplier did not need to start a Mumbai arbitration at all.

Our approach

How we work

We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with associate counsel in Mumbai. This is what you can expect:

  • Clear forum advice: Mumbai, Delhi or the MSME council, as the law requires.
  • Delhi-based coordination: strategy and drafting from NCR.
  • Local support: associate counsel for Mumbai filings and appearances.
  • Cost clarity: associate counsel fees agreed in advance.
  • Written fee terms: agreed stage by stage, never linked to the outcome.
Avoid these

Mistakes in Delhi–Mumbai disputes

  • Filing in Delhi for a Mumbai-seated arbitration
  • Missing the MSME council route because the contract names Mumbai
  • Assuming the Bombay High Court hears all Mumbai matters
  • Not checking the NCLT bench by the company's registered office
  • Delaying enforcement against Mumbai assets
  • Signing Mumbai seat clauses without considering the cost
Banks, receivables and property

Enforcing against Mumbai assets

Many companies with operations across India hold their main bank accounts and treasury in Mumbai. An award holder can file execution in the Mumbai court with jurisdiction over those accounts, even if the arbitration was seated in Delhi, under Sundaram Finance v Abdul Samad (2018). Attachment of bank accounts is often the fastest route to payment. For foreign awards, the Bombay High Court hears enforcement petitions for assets in its original jurisdiction.

Identify the debtor's banks, receivables from Mumbai customers, and property early, ideally during the arbitration. A Section 9 order to preserve assets may be sought if there is a risk of dissipation.

Insolvency and company matters

NCLT Mumbai

The NCLT Mumbai bench is one of the busiest benches, hearing insolvency applications against companies registered in Maharashtra, oppression and mismanagement petitions, and schemes of arrangement. A creditor in NCR seeking to file a Section 9 application against a Mumbai company must file before the Mumbai bench. A Mumbai company facing an application from an NCR creditor will defend there. We coordinate with Mumbai counsel for appearances. See insolvency petition.

The defence side

Mumbai buyers facing NCR MSME claims

Mumbai companies buying from MSMEs in Uttar Pradesh, Haryana or Delhi may face references before those states' councils. They should respond promptly, check the supplier's registration date and classification, verify limitation for the arbitration stage, and use the conciliation stage to settle where the debt is genuine. A council award can be challenged only after depositing 75% of the amount. See MSME claim defence.

For new contracts

Choosing a seat for Delhi–Mumbai contracts

Where both parties are strong, a Mumbai or Delhi seat is often negotiated. A neutral approach is an institutional clause, such as MCIA, IIAC or DIAC, with online hearings and a seat in one city, accepting that court support will be there. What matters most is clarity: state the seat, distinguish it from the venue, and avoid unilateral appointment. See arbitration clause drafting.

Practical information

Working with us on Mumbai matters

We meet clients at our Dwarka or Vaishali offices or by video. Our associate counsel in Mumbai handle filings and appearances, with our team attending key hearings in person or by video. We send updates after every hearing and agree a budget, including associate counsel fees, at the start.

Urgent orders

Section 9 relief against Mumbai parties

Where a Mumbai counterparty is about to sell assets, encash a guarantee or move funds, a Section 9 petition can be filed in the court of the seat. If the seat is Delhi, the Delhi court can grant relief against the Mumbai party, and the order can be enforced against its assets in Mumbai. If the seat is Mumbai, the petition is filed in the Mumbai court with jurisdiction. For foreign-seated arbitrations, the Mumbai court where the assets are can grant relief under the proviso to Section 2(2).

Prepare the evidence of urgency carefully: documents showing the threatened act and its timing, and the harm it would cause. Courts in both cities grant urgent orders where the case is clear, and both require arbitration to start within 90 days of a pre-arbitration order.

Loans, investments and funds

Financial sector disputes

Mumbai-based banks, NBFCs, funds and investors often have contracts with NCR borrowers, investee companies and partners. Bank loan claims above ₹20 lakh go to the DRT, not arbitration. NBFC loans, venture debt, investment agreements and fund documents often have arbitration clauses, frequently with Mumbai seats and institutional rules such as MCIA or SIAC. Disputes concern defaults, enforcement of security, investor exit rights and valuation. See joint venture arbitration and loan arbitration.

Societies and developers

Mumbai redevelopment and real estate

Mumbai's housing society redevelopment projects produce disputes between societies, members and developers over delays, alternative accommodation, rent, and the developer's sale of free-sale units. Many development agreements contain arbitration clauses, and the Bombay High Court frequently decides Section 9 petitions in such disputes, sometimes directing dissenting members to vacate so that redevelopment can proceed. NCR investors in Mumbai redevelopment projects should check the development agreement's dispute clause and the society's resolutions.

London, Singapore and Mumbai

Shipping and charter disputes

Many shipping contracts with Mumbai-based shipowners, operators and charterers choose London arbitration under LMAA terms or Singapore arbitration, with English law. NCR importers, exporters and charterers may find themselves in these arbitrations. Awards from London and Singapore are enforceable in India under Part II. Where security is needed against a vessel, the Bombay High Court's admiralty jurisdiction allows arrest in Mumbai port for a maritime claim, even while the arbitration proceeds abroad.

Release dates and rights

Media and entertainment disputes

NCR producers, content owners and distributors deal with Mumbai studios, platforms and music labels. Disputes over production payments, rights windows, release schedules and music licences are often urgent, because a release date may be at stake. These contracts usually have arbitration clauses, often seated in Mumbai. Urgent relief under Section 9, to stop an unauthorised release or protect rights, must be sought quickly, with a clear account of the rights chain and the harm.
