The Singapore International Arbitration Centre (SIAC) is one of the most popular arbitral institutions for Indian businesses. Indian parties have for years been among its largest groups of foreign users, choosing Singapore for its neutral seat, supportive courts, experienced arbitrators and proximity to India. Many Indian joint venture, investment, shipping, construction and technology contracts with foreign parties choose SIAC arbitration seated in Singapore, and some contracts between two Indian parties do too.
This page is for Indian businesses with SIAC clauses, whether claimants or respondents. In short: SIAC cases now run under the SIAC Rules 2025, which brought in a streamlined procedure for smaller claims, changes to the expedited procedure, preliminary protective orders and provisions on third-party funding; Indian courts can grant interim relief under Section 9 to support a Singapore-seated arbitration unless the parties have excluded it; and a SIAC award made in Singapore is a foreign award enforceable in India under Part II of the Arbitration Act, on narrow grounds.
SIAC arbitration costs more than Indian institutional arbitration, and fees are in Singapore dollars. Plan the budget at the start.

Why Indian parties choose Singapore
Singapore offers a neutral seat for disputes between Indian and foreign parties: its courts are known for supporting arbitration and intervening rarely, its arbitration law is based on the UNCITRAL Model Law, and it is close to India geographically and in time zone. SIAC has a large pool of arbitrators familiar with Indian law and business, and has had a representative presence in India.
For a foreign party contracting with an Indian company, Singapore offers comfort that disputes will not be decided in Indian courts, which have historically been slow. For an Indian party, Singapore is often more acceptable than London or Paris, and less costly. The Supreme Court in PASL Wind Solutions v GE Power Conversion (2021) held that even two Indian parties may choose a foreign seat, and the resulting award is a foreign award enforceable under Part II.

Section 9 relief in India for a Singapore arbitration
Before 2016, Indian courts' power to support foreign-seated arbitrations was uncertain after BALCO (2012). The 2015 amendment added a proviso to Section 2(2), making Sections 9, 27 and 37(1)(b) available to international commercial arbitrations seated outside India, unless the parties have agreed otherwise. So a party to a SIAC arbitration can ask an Indian court for urgent relief, such as an injunction or attachment, against assets in India.
Indian courts have granted such relief in many cases, including where a SIAC emergency arbitrator had already made an order. In Amazon v Future Retail (2021), the Supreme Court held that an emergency award in an India-seated SIAC arbitration was enforceable under Section 17(2). For a Singapore-seated case, an emergency arbitrator's order is not directly enforceable in India as an order of an Indian tribunal, but Indian courts give it weight in a Section 9 application.
Enforcing a SIAC award in India
India has notified Singapore as a reciprocating territory under the New York Convention, so a SIAC award made in Singapore is a foreign award under Section 44. The award holder files an enforcement petition in the High Court with jurisdiction over the award debtor's assets, under the commercial division. The court can refuse enforcement only on the grounds in Section 48, which are narrow: incapacity, invalid agreement, lack of notice or inability to present the case, award beyond the submission, irregular composition or procedure, award not binding or set aside, non-arbitrability, and conflict with the public policy of India in its limited sense after the 2015 amendment.
Indian courts have enforced many SIAC awards, and the Supreme Court has repeatedly said that Section 48 does not permit a review of the merits (Vijay Karia v Prysmian, 2020). Once the court is satisfied, the award is deemed to be a decree of that court under Section 49 and can be executed.

Enforcing a SIAC award against an Indian distributor
Here's a made-up example. A Singapore medical device company obtained a SIAC award for USD 1.4 million against its former Indian distributor for unpaid invoices and stock. The distributor had participated in the arbitration, lost, and then argued in the Delhi High Court enforcement proceedings that the award was against public policy because the tribunal had wrongly applied Indian contract law on liquidated damages.
We acted for the award holder. Relying on Vijay Karia and the 2015 amendment narrowing public policy, we argued that the objection was an attempt to review the merits, which Section 48 does not allow. During the proceedings, the court directed the distributor to deposit part of the award amount. The court then rejected the objections and held the award enforceable as a decree. Execution against the distributor's receivables followed, and the parties settled the balance.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with counsel in Singapore where needed. This is what you can expect:
- Indian side covered: Section 9 relief and enforcement in Indian courts.
- Coordination: working with Singapore counsel on the arbitration itself.
- Budget planning: realistic cost estimates in SGD and INR.
- Enforcement focus: asset tracing and execution planning from the start.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in SIAC cases
- Ignoring a SIAC notice in the belief that it cannot be enforced in India
- Filing a Section 34 challenge in India against a Singapore-seated award
- Excluding Section 9 relief in the clause without meaning to
- Not budgeting for SGD costs and deposits
- Missing the time limit to challenge in Singapore
- Waiting until the award to think about assets in India
SIAC rules with an Indian seat
Parties can choose SIAC to administer an arbitration seated in India, for example in New Delhi or Mumbai. The award is then a domestic award under Part I of the Arbitration Act, subject to Section 34 challenge in the Indian court of the seat and, for domestic cases, the Section 29A timelines. This combines SIAC's administration with Indian court supervision.
This option suits parties who want institutional quality but prefer Indian law and courts, for example where both parties are Indian or the assets are in India. It also allows an emergency arbitrator's order to be enforced in India under Section 17(2), following Amazon v Future Retail (2021). The costs are still on SIAC's scale, so compare them with Indian institutions before choosing.
Responding to a SIAC notice
An Indian company that receives a SIAC notice of arbitration should respond within the time allowed under the rules, even if it believes the claim is baseless or the clause invalid. Jurisdictional objections should be raised in the response and before the tribunal, which can rule on its own jurisdiction. A respondent that does not participate risks an award made without its input, which will be enforceable in India unless a Section 48 ground applies.
The response should also nominate an arbitrator if the clause provides for a three-member tribunal. Choosing a nominee familiar with Indian law and practice is often valuable for an Indian respondent. Consider whether a counter-claim exists, and whether early settlement discussions or SIAC-administered mediation could resolve the dispute.
Costs and security for costs
SIAC requires deposits towards the tribunal's fees and administrative costs, usually shared equally. If one party does not pay its share, the other may have to pay it to keep the arbitration going, and recover it later in the award. The tribunal can order security for costs against a claimant in some circumstances, for example where there is reason to believe the claimant cannot pay an adverse costs award.
The successful party usually recovers a substantial part of its costs, including legal fees, under the principle that costs follow the event, though the tribunal has discretion. For Indian parties, the exchange rate and the cost of foreign counsel are significant, and budgeting should allow for currency movements.
Third-party funding
Third-party funding, where a funder pays the costs of the arbitration in return for a share of the proceeds, is permitted for international arbitration in Singapore. The SIAC Rules 2025 require disclosure of the existence of a funding arrangement and the funder's identity, so that conflicts of interest can be checked. In India, the position on third-party funding is less settled, but courts have not treated it as unlawful in principle, and some funders are active in Indian disputes.
For an Indian claimant with a strong claim but limited cash, funding can make a SIAC arbitration possible. The terms should be read carefully, especially the funder's share, control over settlement, and what happens if the case is lost.
Asset tracing before enforcement
An award is only as good as the assets it can reach. Before or during the arbitration, identify the award debtor's assets in India and elsewhere: bank accounts, receivables from customers, real estate, shares in subsidiaries, and intellectual property. In India, public records from the Registrar of Companies, land records, court records and credit reports can help.
If there is a risk that assets will be moved, a Section 9 application in India can seek an order restraining disposal or requiring security, even while the SIAC arbitration is pending. After the award, enforcement in India can be combined with execution against the identified assets, which speeds recovery.
Challenges in Singapore
A Singapore-seated award can be challenged in the Singapore High Court under the International Arbitration Act, on grounds based on the Model Law, such as invalid agreement, lack of notice, excess of jurisdiction, irregular procedure, breach of natural justice and public policy. The time limit is three months from receipt of the award. Singapore courts set aside awards rarely.
If a set-aside application is pending in Singapore, an Indian court hearing an enforcement petition may adjourn its decision and order security under Section 48(3). Plan both sets of proceedings together.
Drafting a SIAC clause for an Indian contract
SIAC publishes a model clause, which parties can adapt. For contracts involving an Indian party, settle these points: the seat (Singapore, or an Indian city if you want an Indian award); the number of arbitrators; the language; the governing law of the contract; whether Section 9 relief in India is preserved, which it is unless the parties exclude it; and whether the emergency arbitrator and expedited procedures should apply. Avoid ambiguity such as "arbitration in Singapore under Indian law" without saying whether Singapore is the seat or only the venue, which has caused years of litigation in some cases.
If both parties are Indian and want SIAC administration but an Indian award, say expressly that the seat is in India. If they want a foreign award, say the seat is Singapore, and remember that the Supreme Court in PASL Wind (2021) allowed this.
Interim relief from the tribunal itself
Once the tribunal is constituted, it can grant interim relief under the SIAC Rules, such as orders to preserve assets, maintain the position, or provide security. For a Singapore-seated arbitration, such orders are enforceable in Singapore, but not directly in India as orders of an Indian tribunal. To give them effect against assets in India, a party may apply under Section 9 to an Indian court, which can consider the tribunal's order and grant similar relief.
Section 9(3) limits court relief once an India-seated tribunal is constituted, but for foreign-seated arbitrations Indian courts have been willing to act where the tribunal's order cannot be enforced in India and the need is real.
