Gujarat's industries supply raw materials, chemicals, pharmaceuticals, textiles, ceramics, plastics and engineering goods to businesses across India, including many in Delhi NCR. NCR manufacturers buy inputs from Gujarat, NCR brands source products there, and Gujarat companies sell into NCR markets. Many supply contracts choose Ahmedabad or another Gujarat city as the seat of arbitration.
This page is for Delhi NCR businesses with Gujarat counterparties or Gujarat-seated arbitrations, and for Gujarat businesses with NCR disputes. We handle Gujarat matters from Delhi NCR, with associate counsel in Ahmedabad. In short: for domestic arbitrations seated in Gujarat, Section 9 and Section 34 petitions go to the commercial court of the district, because the Gujarat High Court has no ordinary original civil jurisdiction for commercial matters; Section 11 applications, international matters and appeals go to the High Court; companies registered in Gujarat come under the NCLT Ahmedabad bench; and MSME suppliers file before the council of their own location.
For a Delhi buyer facing a claim from a Gujarat MSME, or a Delhi supplier facing a Gujarat buyer, the forum rules decide much of the strategy.

Chemical and pharmaceutical supply disputes
Disputes over chemicals and pharmaceutical inputs usually turn on specifications and test results: whether a batch met the agreed purity, assay or impurity limits, which test method applies, and whether the buyer tested promptly and properly. Contracts should specify the test method, the laboratory, the time for testing and objection, and what happens to rejected batches. Preserve retained samples, which are often decisive.
Where the supplier is a Gujarat MSME and the buyer in NCR, the supplier may file before the Gujarat council, and the buyer's defence will rest on its timely written objections and test reports. See supply contract arbitration.

Entities in GIFT City.
A Noida pharma buyer and a Gujarat API supplier
Here's a made-up example. A Noida formulation company bought an active pharmaceutical ingredient from a Gujarat supplier, registered as a small enterprise. After two batches failed an impurity test at the buyer's plant, the buyer withheld ₹1.3 crore, and the supplier filed a reference before the Gujarat council for its area, claiming the amount with interest.
We acted for the Noida buyer, with Gujarat counsel, and most hearings were online. The buyer had sent rejection notes with test reports within 10 days of receipt for the two batches, and retained samples. An independent laboratory, agreed at conciliation, confirmed the failure for one batch and passed the other. The parties settled: the buyer paid for the passed batch with interest, and the supplier replaced the failed batch.
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with associate counsel in Ahmedabad. This is what you can expect:
- Supply chain experience: chemical, pharma, textile and component disputes.
- MSME understanding: claims and defences before the right council.
- Delhi-based coordination: strategy and drafting from NCR.
- Cost clarity: associate counsel fees agreed in advance.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in Delhi–Gujarat disputes
- Filing a domestic Section 34 petition in the Gujarat High Court
- Not recording test failures and rejections promptly
- Ignoring a Gujarat council notice
- Filing in Delhi for a Gujarat-seated arbitration
- Missing the NCLT Ahmedabad bench for Gujarat companies
- Leaving test methods unclear in supply contracts
Textile and garment sourcing
NCR fashion brands and garment exporters source fabrics from Surat and Ahmedabad mills and traders. Disputes concern shade and quality variations, delivery delays, short quantities and payment. Many suppliers are MSMEs. Clear purchase orders with specifications, approved samples, inspection at dispatch, and written objections on receipt reduce disputes and strengthen the buyer's position if one arises.
GIFT City contracts
NCR businesses increasingly deal with entities in GIFT City: banks offering foreign currency loans, aircraft and ship lessors, funds and insurers. These entities are regulated by the International Financial Services Centres Authority and are treated as non-residents for many foreign exchange purposes. Contracts with them may choose arbitration seated in GIFT City or elsewhere. Check whether the arbitration would be an international commercial arbitration, and which court would supervise it, before signing.
NCLT Ahmedabad
The NCLT Ahmedabad bench hears insolvency applications and company matters for companies registered in Gujarat and other areas within its jurisdiction. NCR creditors filing against a Gujarat company file there; Gujarat creditors filing against NCR companies file before the bench for the company's registered office. See insolvency petition.
Enforcing against Gujarat assets
An award holder can file execution in the Gujarat district court with jurisdiction over the debtor's assets, such as a factory in an industrial estate, receivables or bank accounts, even if the arbitration was seated in Delhi (Sundaram Finance v Abdul Samad, 2018). Identify assets early, including plant and machinery, which is often the main asset of manufacturing debtors.
Working with us on Gujarat matters
We meet clients at our Dwarka or Vaishali offices or by video. Associate counsel in Ahmedabad and other Gujarat cities handle filings and appearances, with our team attending key hearings in person or by video. Gujarati documents are translated where needed. We agree a budget, including associate counsel fees, at the start.
Section 9 relief in Gujarat
For domestic Gujarat-seated arbitrations, Section 9 petitions go to the commercial court of the seat; for international ones, to the High Court; and for Delhi-seated arbitrations, the Delhi court can grant relief against a Gujarat party, enforceable in Gujarat. In supply disputes, common orders include preservation of disputed batches and retained samples for testing, deposit of disputed amounts, and protection against bank guarantee invocation on the narrow grounds. See commercial injunction.
Gujarat MSME councils
Gujarat has councils for different regions. Suppliers located in Gujarat file before the council for their area through the MSME ODR portal, regardless of any arbitration clause, after Mahakali Foods (2022), itself a Gujarat case. NCR buyers facing these claims should check the supplier's registration date and classification, the delivery and acceptance dates, limitation, and the interest calculation. See MSME claim defence.
Ports and logistics
Gujarat's ports handle a large share of India's container and bulk cargo. NCR importers and exporters whose cargo moves through these ports face disputes over demurrage, detention, damage and delays. Carriage and terminal contracts usually have their own dispute clauses. For claims against vessels, admiralty jurisdiction allows arrest in port to secure a maritime claim; speed is essential.
Ceramics and Morbi
NCR distributors and dealers of tiles and sanitaryware sourced from Morbi and other Gujarat clusters often have dealer agreements with manufacturers. Disputes concern credit notes, schemes, damaged supplies, territory and termination. Many manufacturers are MSMEs, so dealers who fall behind on payments may face council claims with statutory interest. Keep scheme circulars, credit notes and reconciliation statements. See franchise and distributor arbitration.
Diamonds and jewellery
Surat is the world's largest centre for cutting and polishing diamonds, and NCR jewellers and traders deal with Surat firms. Trade in diamonds is often on credit, memo or consignment terms, with disputes over payment, return of goods on memo, and quality grading. Many transactions are documented only by memos and invoices. Trade bodies sometimes offer their own dispute resolution, and contracts may contain arbitration clauses. Keep memos, invoices and grading certificates carefully.
Rajkot and the engineering clusters
Rajkot, Jamnagar and nearby clusters produce pumps, castings, forgings, brass parts and auto components, many sold to NCR buyers. Many of these manufacturers are MSMEs located in Gujarat, who can file before the council for their area if NCR buyers pay late. NCR buyers should record quality objections within 15 days and pay undisputed amounts on time to avoid statutory interest.
Choosing a seat for NCR–Gujarat contracts
Many disputes between NCR businesses and Gujarat suppliers turn on a clause that names "Ahmedabad" or "Delhi" without saying whether it is the seat or only the venue. After BGS SGS Soma (2019), a sole named venue is usually treated as the seat, which decides whether a Section 34 challenge goes to the Gujarat High Court or courts in Delhi. If you are a Delhi or Noida buyer, you will usually prefer a Delhi seat; a Gujarat supplier will prefer Ahmedabad. Whichever is agreed, say "seat" expressly, allow hearings by video, and consider institutional rules so that appointment does not depend on a court application. Remember that a micro or small supplier's claim before a Facilitation Council goes to the council where the supplier is located, whatever the contract says. See seat vs venue in arbitration.
Pre-institution mediation in Gujarat
Where a dispute with a Gujarat party is to be litigated rather than arbitrated, and it is a commercial dispute of ₹3 lakh or more with no genuine need for urgent relief, Section 12A of the Commercial Courts Act requires pre-institution mediation first. In Gujarat, this is conducted through the Legal Services Authorities designated under the 2018 Rules for the district where the suit would be filed. If the Gujarat party does not participate, a non-starter report allows the suit to be filed. We prepare the application, attend online where permitted, and file the suit promptly if mediation fails. See is pre-litigation mediation mandatory.
