Kolkata is the commercial centre of eastern India, home to steel, engineering, mining, tea, jute and trading companies, and to several large public sector undertakings. Delhi NCR contractors, suppliers and service providers work on projects for Kolkata-headquartered companies across eastern India, and many contracts choose Kolkata as the seat of arbitration.
This page is for Delhi NCR businesses with Kolkata counterparties or Kolkata-seated arbitrations, and for Kolkata businesses with NCR disputes. We handle Kolkata matters from Delhi NCR, with associate counsel in Kolkata. In short: for domestic arbitrations seated in Kolkata, Section 9 and Section 34 petitions go to the Calcutta High Court's original side or the city commercial courts, depending on value; Section 11 applications for domestic arbitrations seated in West Bengal go to the High Court; companies registered in West Bengal come under the NCLT Kolkata bench; and MSME suppliers file before the council of their own location.
Contracts with Kolkata PSUs often contain older appointment clauses that can now be challenged. We check that first.

PSU contracts and appointment clauses
Contracts with Kolkata-headquartered public sector undertakings in steel, coal, mining, engineering and shipping often contain older arbitration clauses allowing a senior officer of the undertaking to appoint the arbitrator, or requiring the contractor to choose from a panel the undertaking controls. After Perkins Eastman (2019) and CORE (2024), such clauses are open to challenge. An NCR contractor can object to the undertaking's appointee and seek a neutral appointment under Section 11 in the Calcutta High Court.
PSU contracts may also bar interest or limit claims. The Supreme Court in Union of India v Larsen & Toubro (2026) considered contractual bars on interest, and held that post-award interest stands on a separate footing. Read the contract's interest and excepted matters clauses carefully when framing claims.

A Noida contractor and a steel PSU
Here's a made-up example. A Noida electrical contractor completed a substation package at a steel plant in Odisha for a Kolkata-headquartered PSU, under a contract seated in Kolkata. The PSU withheld ₹3.1 crore and its director appointed a retired PSU official as sole arbitrator.
We objected to the appointee under Section 12(5) and CORE, and filed a Section 11 application in the Calcutta High Court through Kolkata counsel. The High Court appointed a retired judge. The arbitration ran largely online, with one evidence hearing in Kolkata. The tribunal awarded most of the withheld amount, and when the PSU filed a Section 34 petition, the court directed deposit of the award as a condition of stay, following Pam Developments (2019).
How we work
We are a litigation and advisory practice led by Advocate BK Singh, with offices in Dwarka (New Delhi) and Vaishali (Ghaziabad), working with associate counsel in Kolkata. This is what you can expect:
- PSU experience: appointment challenges and contract clauses.
- Forum accuracy: High Court or city court, by value.
- Delhi-based coordination: strategy and drafting from NCR.
- Cost clarity: associate counsel fees agreed in advance.
- Written fee terms: agreed stage by stage, never linked to the outcome.
Mistakes in Delhi–Kolkata disputes
- Accepting a PSU's own appointee as arbitrator
- Filing in the wrong Kolkata court for the value
- Filing in Delhi for a Kolkata-seated arbitration
- Ignoring interest bar and excepted matters clauses
- Accepting unconditional stays of money awards
- Missing the NCLT Kolkata bench for West Bengal companies
Tea, jute and commodity trades
Kolkata's tea auctions, jute trade and commodity markets involve many contracts with arbitration clauses, sometimes under trade association rules. Disputes concern quality, short supply, price differences on default and payment. NCR buyers of tea, jute products and commodities, and NCR sellers to Kolkata traders, should check the contract terms and trade rules, which may set short time limits for claims. See trade export import arbitration.
NCLT Kolkata
The NCLT Kolkata bench hears insolvency applications and company matters for companies registered in West Bengal and nearby states within its jurisdiction. NCR creditors filing against a Kolkata company file there. Many Kolkata companies are old family-run businesses, and oppression and mismanagement disputes among family shareholders are common. See oppression and mismanagement.
Enforcing against Kolkata assets
An award holder can file execution in the Kolkata court with jurisdiction over the debtor's assets, even if the arbitration was seated in Delhi (Sundaram Finance v Abdul Samad, 2018). For PSUs that are companies, execution proceeds like any other decree; for government departments, Section 82 of the CPC requires a period for satisfaction. Identify the debtor's banks, receivables and property early.
Choosing a seat for NCR–Kolkata contracts
For private contracts with Kolkata companies, consider a Delhi seat or a neutral institutional clause with online hearings. For PSU tenders, the seat is usually fixed; focus on ensuring the appointment process is neutral and the claims clauses are fair. State the seat clearly and distinguish it from the venue.
Working with us on Kolkata matters
We meet clients at our Dwarka or Vaishali offices or by video. Associate counsel in Kolkata handle filings and appearances, with our team attending key hearings in person or by video. Arbitrations themselves can be held largely online. We agree a budget, including associate counsel fees, at the start.
Section 9 relief against Kolkata parties
For Kolkata-seated domestic arbitrations, Section 9 petitions go to the Calcutta High Court's original side or the city commercial courts depending on value; for Delhi-seated arbitrations, the Delhi court can grant relief against a Kolkata party, enforceable in Kolkata. In PSU contracts, the most common urgent issue is invocation of performance guarantees, where relief is available only on the narrow grounds of egregious fraud, irretrievable injustice or invocation not in terms of the guarantee. See bank guarantee dispute.
Mining and logistics contracts in eastern India
Contracts for mining services, coal and ore transportation, washeries, and rail and port logistics in eastern India often involve Kolkata-headquartered companies and PSUs. Disputes concern quantities, rates, escalation, idle time, and termination. Claims can be large and depend on detailed operational records: dispatch data, weighbridge records, equipment logs and correspondence. Preserve these from the start, and engage technical experts early.
Jharkhand, Odisha and the north-east
Many Kolkata companies operate projects in Jharkhand, Odisha, Assam and the north-eastern states. Where the contract chooses Kolkata as the seat, the Calcutta courts supervise even though the work is elsewhere. Where it chooses a seat in another state, that state's courts supervise. Check the clause, not the project site, before filing.
West Bengal MSME council
MSME suppliers located in West Bengal file before the West Bengal council through the MSME ODR portal. NCR buyers of West Bengal MSME goods may face such references; NCR MSME suppliers to Kolkata buyers file before their own state's council. Section 16 interest at three times the bank rate applies, and a buyer must deposit 75% of an award before challenging it. See MSME claim defence.
Family business disputes
Kolkata has many long-established family business groups, and disputes among family members over control, division of companies and properties are common. Contractual disputes under family settlements or shareholders' agreements with arbitration clauses can be arbitrated; oppression claims go to the NCLT Kolkata bench; and property partitions go to the civil courts. A mediated family settlement often resolves all of these together. See mediation services.
Old tenancies and rent control
Many commercial premises in Kolkata are let under old tenancies protected by the West Bengal Premises Tenancy Act, 1997. Disputes about eviction and rent under such protected tenancies are for the forums under that Act and are not arbitrable, after Vidya Drolia (2020). Newer commercial leases outside the Act's protection can be arbitrated if they contain a clause. Check which applies before choosing a forum. See lease and rent arbitration.
Engineering and fabrication suppliers
Howrah and the industrial areas around Kolkata have many engineering and fabrication units supplying railways, steel plants, ports and power projects. NCR EPC contractors buying from these suppliers, and Kolkata suppliers selling to NCR buyers, face familiar supply disputes. Where the supplier is an MSME in West Bengal, the state council is available to it, with Section 16 interest.
Pre-institution mediation in Kolkata
Commercial suits without urgent relief in the Kolkata courts require pre-institution mediation under Section 12A through the legal services authority. Where the contract has an arbitration clause, the arbitration route applies instead, and Section 12A does not.
